Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Calume iOS app and any related services we operate (collectively, the "Service"). By downloading, installing, or using Calume you agree to be bound by these Terms. If you do not agree, do not use the Service.
Calume is distributed through the Apple App Store. Your use of the app is also subject to Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms supplement the Apple Standard EULA; if there is any conflict between these Terms and the Apple Standard EULA regarding your licence to use the app obtained from the App Store, the Apple Standard EULA governs to the extent of that conflict. Apple is not a party to these Terms and is not responsible for the Service or its content, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
1. Eligibility
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use Calume. By using the Service you represent that you meet this requirement.
2. Your account
You sign in using Sign in with Apple. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account. You agree to notify us promptly if you suspect unauthorised use.
3. Your content
"Your Content" means all data you create or import in Calume, including time entries, categories, goals, and tasks. You retain full ownership of Your Content. By using the Service you grant us a limited, worldwide, non-exclusive licence to host, store, and transmit Your Content solely to provide and improve the Service. We will not use Your Content for advertising or share it with third parties except as described in our Privacy Policy.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law;
- Attempt to gain unauthorised access to our systems, other users' accounts, or data;
- Interfere with or disrupt the Service, servers, or networks connected to the Service;
- Reverse-engineer, decompile, or disassemble any part of the Service, except to the extent expressly permitted by applicable law;
- Reproduce, redistribute, or sublicense the Service or any part of it;
- Use the Service to transmit malware, spam, or other harmful content.
5. Calume Pro subscription
5.1 Plans and pricing
Calume offers a free tier and a paid subscription ("Calume Pro"). Pro is available as a monthly or yearly plan. Current pricing is displayed in the app before purchase. Prices may change; any change will apply from the next renewal period and will not affect a current billing cycle.
5.2 Free trial
New subscribers may be eligible for a free trial (currently 1 week). If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the plan price shown at sign-up.
5.3 Billing and renewal
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID account. You can manage or cancel your subscription in your device's App Store settings.
5.4 Refunds
All purchases are processed by Apple. Refund requests are subject to Apple's refund policies. We do not process refunds directly.
6. HealthKit and Calendar data
Calume may access Apple Health (HealthKit) and Calendar (EventKit) data with your explicit permission. This data is used solely to display information on your timeline. We do not use Health or Calendar data for advertising. For details on how this data is handled, see our Privacy Policy.
7. Intellectual property
All rights, title, and interest in the Service (excluding Your Content), including the app design, graphics, trademarks, and underlying code, belong to us or our licensors. These Terms do not grant you any right to use our trademarks, branding, or logos.
8. Feedback and suggestions
"Feedback" means any suggestion, feature request, idea, recommendation, comment, or other input you submit to us about Calume — whether through an in-app feature-request or feedback feature, by email, or by any other means.
Feedback is not confidential, and submitting it creates no obligation on our part. We are free to use, modify, adapt, publish (including in edited or summarised form), implement, or otherwise exploit any Feedback for any purpose, commercially or otherwise, without any restriction, attribution, or compensation to you. To the extent any rights in your Feedback do not automatically vest in us, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable licence to use it for any purpose.
You agree that implementing an idea similar to your Feedback creates no obligation to you, including where we developed the same or a similar idea independently. You represent that any Feedback you submit is your own and does not infringe the rights of any third party, and you will not submit Feedback that is confidential to, or owned by, someone else.
9. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
Nothing in these Terms excludes or limits any warranty that cannot be excluded or limited under applicable law, including consumer protection laws in Norway or the European Economic Area.
10. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable Norwegian law.
11. Termination
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 3, 8, 9, 10, 12, and 13) will survive.
12. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of Norway, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be submitted to the exclusive jurisdiction of the courts of Norway.
If you are a consumer resident in the European Economic Area, you also retain any mandatory consumer rights granted to you by the laws of your country of residence, and nothing in these Terms affects your right to rely on those provisions. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the app or by updating the "Last updated" date above. Your continued use of Calume after a change becomes effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service.
